In a civil case of fraud, the victim is often able to seek compensation or other remedies by filing a lawsuit against the person who committed the fraud. In general, to prove fraud you need to establish that:

  • The other party knowingly made a false statement or purposefully kept important information from you
  • The party intended to deceive or defraud you
  • You relied on that person’s false statement and you suffered financial or emotional harm as a result of the fraud

Predatory lending occurs when a creditor takes advantage of borrowers through deceptive or unfair practices such as charging excessive fees or lying about the loan terms. Another illegal lending practice includes charging interest rates above the legal limit. There are consumer protection laws in place to protect borrowers from unfair lending practices. When these laws are violated, the loan is unlawful and can be challenged in court.

Identity theft is a criminal offense in Texas. It occurs when someone uses another person’s name, Social Security number, financial account information, or other personal identifying information to commit fraud. If you believe you are a victim of identity theft, you should report the crime to your local law enforcement agency as well as the Federal Trade Commission. You may also be able to file a lawsuit against the person who stole your identity.
